Hujjat Regarding the Sale of a Vineyard

The case is as stated below:

Es-Seyyid Hafız Mehmed Nuri, the provost of Beşiktaş town, recorded it.

‘Seal’

Proven to have the power of attorney for Ezmeragda, (the daughter of Lagor, and a Christian resident of Kuruçeşme village of Besiştaş town, which is one of  the districts of Galata city), by the testimonials of  non-Muslim subjects, Mütevellaki, (son of Andria) Yorgi (son of Yani) and Dimitraki(son of Yorgi), declared by proxy and stated in the presence of Elia, (the son of Musa who is the elder son of Sadri) who is the legally registered attorney of Sevil, (daughter of Hazkiya, a Jewish subject, also known as Haym), my mandator, Ezmeragda (a Christian subject), said that;

“I sold, assigned and ceded the vineyardand whatever occupies it, which was my property with the right of useuntil the following deal was contracted, a piece of approximately 23 decares of vineyard around the gardens of Ortaköy, dependency of the mentioned town [Beşiktaş], which is leased to the Sultan Bayezid Veli Endowment and bordered by the lands of non-Muslim Ovannes and Elmiye as well as a canyon and a public road, to the aforementioned Jewish mandator, also known as Sevil, in return for 620 quruş, with a firm sale contract, which includes the offer and the acceptance of the parties and excludes any corrupting stipulation and collusion; and after she has accepted the sale and taken possession of the said vineyard and paid the agreed price of 620 quruş and I have collected the whole payment from her hand completely, both of us confirmed the cancellation of each other’s debt and discharged each other from all possible lawsuits in relation to any cheating or fraud about the sale concerned. Hereafter, I have by no means any connection or relation with the described vineyard anymore and [the vineyard] became the purchased property of Sevil, the aforementioned Jewish mandator, with all the rights of use of it.”

After the legal confirmation of what happened, it was recorded upon request on the 9th of the Month of Zil-Hijjah 1229. [22 November, 1814]

Witnesses: Nesim, (son of Haym), Mehmed (son of Abdullah), Mahzar Mahmud Ağa, (son of Süleyman) es-Seyyid İbrahim Efendi, (son of es-Seyyid Ebubekir), Isak (son of Behor), Yako, (son of Yişaye), Ovannes (son of Artin), Yasef(son of Haym), Baruh (son of Yako) and others.
